Many people do not understand when Miranda warnings are required to be given in a criminal case. Generally speaking, the police are not required to issue Miranda warnings when they arrive on scene to investigate a report of criminal activity during what is referred to as an investigative detention. In this State College assault case, the police responded to a reported fight, arrived in scene, detained the suspects, and questioned them about their involvement in the fight. The Centre County judge ruled that the men were merely detained and were not in "custody," so Miranda and 5th Amendment rights against self-incrimination were not applicable.
