McAndrews Offices Law Firm This law firm robbed my son and I, eyes wide shut Hi Cheryl, I hope that all is well and that this winter weather hasn’t been too hard on you and Andrew! After several weeks of back and forth negotiations between us and Providence Creek’s attorney regarding the terms of Andrew’s settlement agreement, I am pleased to report that Heidi and I feel that we have negotiated terms that are fair and acceptable. Thus, pending your approval, the agreement is now ready to be signed. I am mailing the agreement out to you along with the cover letter that I’ve copied below, but since we still have a pending due process complaint (we can’t dismiss the complaint until we’re sure we have a final agreement between the parties), I wanted to send it to you via email as well so that you can begin looking it over. The hearing officer has asked us to finalize the agreement by Thursday, if possible, so would ask that you review the attached agreement right away and notify us of any questions or concerns that you have. If you are fine with the terms, then you can print and sign the agreement and return it to me. If the Agreement is acceptable to you, please sign two copies and return two copies to me so that I may forward them to Providence Creek Academy’s attorney. I have enclosed a self-addressed stamped envelope for your convenience. You may retain the third copy of the Agreement for your records. Please note that the bulk of the wording of this Agreement is standard settlement language and the provisions do not preclude you from a future action which might be necessary to enforce the Agreement or to pursue appropriate educational programming for Andrew based on future circumstances. This letter will also serve to memorialize distribution of settlement monies in this matter. Pursuant to the enclosed Agreement, Providence Creek Academy has agreed to make $30,000.00 available to you for reimbursement or payment of Legitimate Educational Expenses for Andrew, Ms. Cheryl King February 17, 2014 Page Two as defined in Paragraph 2 of the enclosed Agreement. McAndrews Law Offices has agreed to waive its entitlement to its contingent fee so that you and Andrew may keep the full $30,000.00 award. Providence Creek Academy has also agreed to pay my office $24,750.00 towards our attorney’s fees. While our total fees on Andrew’s case are over $32,000.00, we have agreed to accept a reduction in our fees from Providence Creek Academy in order to bring this matter to a close so that Andrew can obtain the compensation that is owed to him and begin to benefit from it. Her office is investigating the Delaware charter schools, and how the charter schools are disproportionately discriminating against students of color and students with disabilities, and are failing to appropriately educate them. Ms. Bowie asked if my office had any families who might be willing to testify before the Office of Civil Rights (“OCR”) regarding the issues that their children experienced attending charter schools in DE. I think they would be interested in hearing about Andrew’s case and what you experienced. I also think you would do a great job testifying before OCR. Under your settlement agreement, you can discuss Andrew’s case and the problems that he experienced at Providence Creek, you just cannot disclose the terms of the settlement and the amount of money that you were awarded. Are you interested in participating in the ACLU’s investigation and would you be willing to let me share your name and contact information with Ms. Bowie?
