In 16 years of its existence, Madhya Pradesh Medical Council (MPMC) actions against doctor for unethical practice or medical negligence were marked by inordinate delay despite its mandate to the contrary. Those at the helm of the virtually comatose MPMC do not wince for once when they say dealing with medical negligence is not their priority. TOI tries to bring in focus the MPMC shocking state of affairs three days after Supreme Court while awarding a compensation of Rs 5.96 crore to an NRI for medical negligence came down hard on a Kolkata-based hospital. The court made it clear it was sending out a message that it was not about Anuradha Saha, who died of medical negligence, alone. We therefore hope and trust this decision acts as a deterrent and a reminder, the apex court order said.The nonchalance leaves one at his wits end in the state not known for scoring well on medical facilities front. And those dealing with the MPMC allege the council even keeps the number of medical negligence cases under wraps. Try talking to MPMC presi dent Dr PNS Chouhan about the state of affairs. Dealing with medical negligence is not our priority, Chouhan said, leaving no one in doubt about the ground reality. MPMC, which is affiliated to Medical Council of India (MCI), is headed by state director health services and a registrar is its member secretary. With a shadow on its autonomous status and incomplete quorum, the legality of MPMC is in doubt, he added. There are many cases of medical negligence in the state. Once negligence is proved by any court, MPMC has to initiate action against erring doctors, said NGO Swasthya Adhikar Manch co-convener Amulya Nidhi. He said three cases in Bhopal and Indore, where the MPMC had not initiated action against doctors despite consumer redressal forum asking them to pay fine for negligence. MPMC has not made public number of cases pending with it, he added. Registration of doctors with MPMC is a simple task. As per Medical Council of India (MCI) state council has to resolve cases of negligence in six months. Even in sensitive cases of clinical drug trial, MPMC has failed to complete investigations, said an activist Dr Anand Rai, credited with exposing drug trial. Even after sixteen years of its formation, rules have yet to be formalized, said Rai demanding elected representatives from doctors body should be made part of the MPMC. As per the MPMC Act the body has to have five government and five representatives elected by MPMC members, he added. MPMC ethics-cum-disciplinary committee is investigating complaints of alleged drug trials in Madhya Pradesh, sponsored foreign trip of doctors by pharmaceutical companies. Complaints against doctors continue to remain pending for months, some dating as far back as 2007. As per the Indian Medical Council Professional Conduct Etiquettes and Ethics Regulation (2002) a decision on a complaint against delinquent physician should be taken in six months. In 2010, council panel looking into the alleged drug trial by Dr TP Sahoo and Dr Pradeep Kolekar gave a clean chit based on opinion of Dr P Parikh, who served Tata memorial for 17 years. An RTI document seeking his MCI registration number revealed that Dr Parikh was not registered with the MCI.
