Minimum – Maximum Sentences Of IPC. Maximum Is An Unused Paper Tiger; And Provides Scope For Heavy Bribes !! The guilty judges are not using the death sentence on the plea of rarest of rare case and are allowed to use almost the minimum without justifying why ?? As such, the deterrent sentence turns into a fraud in the Penal Code and, as such, the crimes are in an alarmingly rising trend !! There is almost no fear psychosis in the society to commit crimes and the Penal Code almost completely failed to create that fear psychosis and, as such, completely failed to achieve its aim and objectives !! Let the law makers MPs/ MLAs feel ashamed and repeal the minimum at the earliest ! The most condemnable recent judgement dated 4.9.2013 of Odisha High Court bench of Pradip Mohanty & Biswajit Mohanty which altered the death sentence to 25 years sentence without commutation. When the minimum is life imprisonment why 25 years ?? The most heinous barbaric crime committed by the criminal, Thidu alias Bisi Munda is that he abducted a three years old girl child and raped and murdered her. And, for these judges that is not a rarest of rare crime !! Such decisions are only encouraging the victims’ party to take revenge in like manner – an eye for an eye, a murder for a murder. As such, the crimes are multiplying. Many people are preferring to take law into their hands without going to police & Courts. In many cases the minimum life imprisonment for murder becomes a grand joke & mockery for the victims of crime. The Penal Code have been allowed to be a toy in hands of the pro-criminals in the administration and judiciary !! The pro-criminals as heads of administration commuting death sentence into life imprisonment and life imprisonment into about 14 years and the judges altering the life imprisonment into about 10 years by misusing S-304, IPC and death sentence into even less than the prescribed minimum on the plea or rarest of rare crime !! In such this, democracy turned into criminals’ paradise, corruption raj, loteras’ raj and exploitators’ raj.
