My feelings of compassion and support have been, and continue to be, with the young woman who came forward to say she was the victim of an institutionalized gang rape by a fraternity at the University of Virginia. But I cant forget a core principle of our rule of law system, the a priori presumption of innocence. And the egregious violation of that principle in the Duke la crosse case (especially by those numerous Duke faculty who rushed to judgment and judged wrongly) should not be forgotten. How to balance the very real need to presume the truthfulness of one who charges that she has been so violated with the need to presume innocence at the outset is one of the real issues of justice and morality in our time.
