NAVIGATING THE ROOKER-FELDMAN DOCTRINE. Saturday, May 3, 2014. It started with Rooker in 1923, waited for 60 years, then reared its ugly head again in 1983 with Feldman. These are both U.S. Supreme Court decisions that have essentially become known as the doctrine that prevents a federal district court from being called upon to review a state court judgment. Seems straight forward enough, but then you get into a determination of whether the claims presented to the federal court are inextricably intertwined with the state courts denial in a judicial proceeding. Now, if you followed all that, theres nothing good on TV right now, and you are not a lawyer but interested in these issues in the slightest, then you need to seek professional help because there is something seriously wrong with you. Im thinking there is something seriously wrong with me because I found it quite intresting unraveling the mystery of the applicability of the Rooker-Feldman doctrine in the wake of judicial pronouncements since 1983 that have (in some cases) whittled away at the doctrines precedential value, and (other cases) virtually blasted any last vestage of its value into oblivion. (See e.g. the Exxon Mobile and the Lance decisions). No matter your take on all of this...I feel like this little guy sometimes.
