Nevada Supreme Court Taking Up Uber Jurisdiction La Dispute by C Ryan November 19th, 2014 CARSON CITY — The Nevada Supreme Court has decided to give speedy handling to a petition seeking to prevent a Washoe County judge from presiding over a conflict between the state and Uber. Uber, a private ride service company, has asked the Supreme Court to stop Washoe County District Court Judge Scott Freeman from hearing a request from the Nevada Transportation Authority for a preliminary injunction to stop the company from operating in Las Vegas. Uber maintains that Clark County District Court Judge Douglas Herndon should decide the case because the state’s first complaint was filed in Las Vegas. It accuses the state of judge shopping. The Supreme Court on Tuesday ordered all sides to file arguments with the court by the end of the week. Taxicab regulators say Uber is violating Nevada law by operating a for-hire transportation company without obtaining the required Certificate of Public Convenience and Necessity. Without the certificate, Uber drivers are considered unlicensed operators and are subject to punishment. Uber has maintained that it is not a transportation company but a technology platform that connects riders with an independent network of drivers. The drivers use their own vehicles to deliver the rides, which are ordered through a smartphone app.
