New home building laws introduced last week have tightened licence eligibility to boost consumer protection and stamp out ‘phoenixing’; where a company closes down leaving large unpaid debts, only to re-emerge as a new company trading under a different name. Fair Trading can now consider the conduct of directors, former directors, officers and associates for 3 years before the company was placed into administration.
