No; Rights are unalienable. It is unnecessary to violate Rights in order to provide safety, if executed constitutionally. Martial/military Law only applies within the regular military or within the Militia; never on the population. The Militia are enumerated with power to execute the Laws; the Laws obviously including the Bill of Rights since the Constitution is the supreme Law. The fact is the Constitution never intended safety (or security) to trump rights (or liberty). What else is security for but to protect life, liberty and property? The Constitution enumerates provisions for concurrent security and liberty; the Bill of Rights, and well regulated Militia of the several States *** composed of the body of the People for the common d/Defence of those Rights. It is a general maxim of western political philosophy that people join society and form government for the common d/Defence of life, liberty and property. This maxim is derived from the 1st law of nature--the right to defence of self, family, clan and provisions (food, shelter, etc). Unfortunately, some who allege to promote defense of liberty, also claim that these natural and constitutional truths are nothing but opinion; their way of discounting without actually rebutting anything.
