ACTIONS: Action 1 - Please copy and paste the below letter into the field on the USDA complaint box (aphis.usda.gov/animal_welfare/aw_complaint_form.shtml) Dear Sirs: Kindly direct your immediate attention to the critical case of Nosey the elephant and assign the case High Priority status. If, cases are deemed high-priority based on the following criteria, then Nosey, the elephant’s case surely qualifies. 1. Severity of animal suffering (death or severe injury),2. Past compliance history of facility,3. Potential public or animal safety or health concerns,4. Abusive or potentially violent nature of licensee or registrant.5. Type of facility and species of animal involved, and;6. Severity of the issue resulting in extensive public interest. THEN,1. Nosey has suffered to the degree that now, after OVER TWENTY YEARS OF ABUSE IS CRIPPLED AND STILL BEING USED FOR GIVING RIDES. “[Nosey] undoubtedly suffers from advanced arthritis and degenerative joint disease, resulting in ongoing pain, and most likely permanently impaired limb function.” Philip K. Ensley, D.V.M., Dipl. ACZM 2. Hugo Liebel has a history of CHRONIC NON-COMPLIANCE with nearly 200 USDA citations since 1993. Those include not giving Nosey veterinary care,not taking care of her skin, and having Nosey around children when she has been shown to be dangerous around children. Liebel has a long history of violating the Animal Welfare Act (AWA). These violations include repeatedly chaining Nosey so tightly that she could barely move, repeatedly denying her necessary veterinary care, and allowing dangerous, unsupervised public contact with her. 3. Noseys physical condition compromises her stability in carrying passengers as she carries weight on three legs instead of four. She is in pain, taxing her coping skills. Nosey has a history of violently turning against handlers as she did as recently as 2009. Nosey has also tested positive on a TB test which indicates she may be capable of spreading tuberculosis among people who come into contact with her. 4. Hugo Liebel is mentally unstable and has displayed violence toward people, as well as, toward Nosey. Liebel has been taped verbally attacking passersby and threatening physical violence. youtube/watch?v=Ej_XKx1097EMr. Liebel, according to the affidavit of a former employee, Leibel used the [bullhook] handle, turned off the lights in the performance ring and beat the elephant while she was staked down by all four legs. He also attested that Nosey was routinely shocked with electric prods. 5. Nosey, as an African Elephant, is a critically endangered species and as such should be afforded the utmost protection that a civilized society can afford. 6. There is worldwide outrage over the way USDA is allowing Nosey to be treated. In one effort, USDA and Florida Fish and Wildlife in April 2014, received over 20,000 requests to free Nosey. Currently, on just one campaign there are several thousand people advocating for Nosey, that number will only continue to grow as awareness of Noseys situation is exposed. Hugo Liebels chronic abuse of Nosey clearly warrants USDAs High Priority Designation, license revocation, and an immediate cease-and-desist order. Nothing less is acceptable. It is clear Nosey is limping while carrying people on her back. The fact that this documents Nosey limping with passengers on her back suggests: 1. Hugo Liebel isnt providing proper care for her or he wouldnt continue to use her in her current state. 2. Hugo Liebel is not managing Nosey with public safety in mind. Noseys leg pain is causing her to move unsteadily which means she could more easily fall with passengers on her back or passengers could fall off because the riding frame can not stay balanced. Rather than addressing the violations with a genuine intent to put an end to the illegalities, for what has now been years, USDA officers continue to accept payment of fines allowing both Liebel and USDA representatives to move forward with business as usual. Resultantly:- Nosey the elephant is now severely arthritic and unsteady on her feet, yet, she is being allowed to continue carrying multiple passengers on her back, for many hours a day. Fines are no substitute for enforcement of USDA regulations. - Nosey the elephant has now tested positive for TB on a STATPAK test. As per USDA guidelines on protocol for TB in elephants, Group D (animals that have had Mycobacterium tuberculosis complex isolated from any sample (sputum, stool, tissue, etc.) are considered as culture positive for M. tuberculosis), should not travel or have public contact during the treatment period (12-15 months). Following completion of treatment, the attending veterinarian must verify that the elephant has received treatment as outlined in this protocol, and that adequate drug levels have been achieved. If treatment requirements are not met, travel and public contact is restricted until these are met. Knowingly permitting Nosey to come in contact with the public considering she has presented as TB positive jeopardizes the safety of anyone coming into contact with her. Fines are no substitute for enforcement of USDA regulations. - Nosey the elephant is now in physical pain due to severe arthritis and a chronic skin condition that has not been corrected for several years, as such her ability to cope with the stress and rigor that accompanies months of travel is compromised. Nosey has also demonstrated the ability to turn on her handlers on at least one occasion. Knowingly permitting Nosey to come into contact with the public for the purpose of giving rides jeopardizes the safety passengers and spectators in the near vicinity. Given the current circumstances, permitting Nosey to come in contact with the anyone in near vicinity to her at risk. Fines are no substitute for enforcement of USDA regulations. Witnesses include, members of the animal health community (including Dr. Phillip Ensley, DVM), animal rights organizations (PETA, In Defense of Animals, PAWS, and others) concerned citizens and the USDA, itself. What purpose does having a license serve if the regulations from which that license was born, are not adhered to?In the case of Hugo Liebel and Nosey the elephant, the USDA has failed citizens of the US by continually accepting cash payment in lieu of enforcement of the regulations put in place to protect the public. Doing so allows us to start demonstrating a pattern or history of the problem which in court carries more weight than a series of isolated incidents. For the past several years now, APHIS has conducted numerous inspections on a single elephant, Nosey, that have resulted in an accumulation of nearly 200 violations, many of which are repeat citations. Nosey the elephant, is owned by Hugo Liebel USDA License ##58-C-0288 of Davenport, Florida and is the subject of these inspections. Currently, Nosey has a chronic skin condition that has been allowed to go uncorrected for years. For at least the past month, the elephants eyes have dribbled a white substance. Most significantly, Nosey is crippled and drags her legs along as she hauls passengers on her back. The elephant has been diagnosed by an elephant expert, Dr. Philip K. Ensley, D.V.M., as having advanced degenerative arthritis. Not only is allowing this lame elephant to continue giving rides inhumane, it is downright dangerous for the people riding on her as she is unsteady on her feet. APHIS has been made aware of these issues by many concerned citizens via the USDA/APHIS on-line complaint form over the past month. Video footage and photos documenting Noseys condition at a series of locations from the past month have been made available and, concerns over public safety and animal welfare have been shared with APHIS. Despite acknowledging receipt of the recent complaints and being aware of recent public concerns, APHIS supervisor, Dr. Kay Carter-Corker, Assistant Regional Director with Animal & Plant Health Inspection Service, claims there is nothing more APHIS will do, not can do but, will do. Dr. Carter-Corker also recognizes that APHIS has the power and responsibility to interpret laws. Over the many years that APHIS has supervised the care of Nosey the elephant, the agency has yet to take meaningful action that leads to correcting problems. For example, Noseys skin condition was looked at in March and then again in August of 2014, just as it has been year in and year out for at least seven consecutive years. The skin condition has not improved and yet, APHIS accepts this. Afterall, theyve done their part by simply checking in. Seven years of checking in is not good enough. The truth is, Nosey is the only one who bears the brunt of inaction on the part of those who are suppose to protect her meanwhile the cycle of neglect continues. APHIS appears to have little intention of ever exercising its responsibility to the public by interpreting and enforcing the Animal Welfare Act as it was written and intended nor does the agency seem interested in listening to the many concerns regarding Nosey as expressed by the public. The way that APHIS is conducting itself with regard to Nosey the elephant represents a breach of responsibility to the public. As such, stern and immediate action on the part of you, my Congressman, is warranted. I look forward to learning how you intend to address the problems involving APHIS and the Nosey elephant case. Former employee claims that wasnt the only time. -Nosey has a chronic skin condition that has not been effectively treated. -Nosey has recently begun limping and Liebel continues to pile multiple people on her back for rides. -Nosey has tested positive for TB which is transmittable to humans. Yet, she is allowed to routinely come into close contact with people. -Nosey has also been referred to by her owner as Tiny, Peanut and Dumbo. -Hugo Liebel has also identified himself as Hugo Bloom, Tomi Liebel and Tommy Liebel. -Hugo Liebel has owned or is associated with many circuses including Florida State Family Circus, Liebling Brothers Circus, Liebel Family Circus, Universoul Circus, Shriners Circus and others. Page Guidelines: Together, as we have done before, we can drive the change that will finally bring Nosey the Elephant the peace, safety and dignity she has long been deprived of. In order to do that, here are a few page guidelines that will help us all stay as efficient as possible along the way. 1. To accomplish this we will be appealing to the media, celebrities, politicians and others who have the ability to engage the public. The secondary focus, will be to address the USDA requesting that Noseys case be given critical consideration. Along the way, other actions that are anticipated to further the cause will be implemented. 2. All posts must pertain only to Nosey, or unfortunately, they will have to be deleted. 3. Any information, news or ideas pertaining to Nosey are encouraged. 4. While respectful debate is encouraged, no language of hate, racial slurs, personal attacks will be permitted. Remarks of this nature will be deleted. Persons making such remarks may also be removed from the group. 5. We function best as a mutually supportive team, positivity tempered with resolve and reality will get us to where we want to be. 6.
