Nursing positions that may qualify for H-1B August 18, 2014 USCIS policy memorandum dated July 11, 2014 states that RNs do not qualify for H-1B status which requires a position in the specialty occupation requiring minimum of Bachelor Degree or higher degree. However, USCIS policy memorandum states H-1Bs are possible for advanced nursing position which do require bachelor or higher degree as its minimum entry into the occupations. Depending on the circumstances, RN position in the following occupations may qualify for H-1B status, including but not limited to: Addiction Nurses, Cardivoascular nurses, Critical care nurses, Emergency room nurses, Genetics nurses, Neonatology nurses, Nephrology nurses, Oncology nurses, Pediatric nurses, Peri-Operative (Operating Room) nurses, Rehabilitation nurses and other nurses in who do not work directly with patients but must still have an active registered nurse licenses. Advanced Practice Registered Nurses qualifies for H-1B position based on the regulatory license, scope and standards of practice. The qualifying non-exhaustive list of APRN (Advanced Practice Registered Nurse) includes Certified Nurse-Midwife (CNM); Certified Clinical Nurse Specialist (CNS); Certified Nurse Practitioner (CNP); and Certified Registered Nurse Anesthetist (CRNA).
