OH MY GOD... read this and weep. It is getting literally impossible for us to survive/do business here. Every day there are new incredibly DUMB and unnecessary rules. Especially from customs and BIR. It has never been as difficult to do business in this country as now. I feel very hopeless..... This government is becoming outright dangerous for the country. It will certainly kill all small businesses in our industry. The massacre has already begun.. hundreds closed in the last 2 to 3 years. NO WAY a customs officer can monitor the loading of all export containers in this country. Its so SUUUUPER SUUUUPER IDIOTIC its almost tragically funny. This will result in even more corruption. God save the Philippines. Dear PHILEXPORT Member: It has reached our attention yesterday that the Bureau of Customs is implementing a policy that requires a Customs personnel to monitor the stuffing of containers in factories/warehouses as mandated in Sec. 16, paragraph B, 1, 1.1 of CMO 22-2010 or the Revised Customs Port Operations Manual. This is being implemented by the Container Control Division under Mr. Fidel Villanueva. In a telephone talk with Mr. Villanueva this morning, he said that they have directly advised all BOC processors about this policy two months ago, adding that they have a list of those which have been given copies of this policy. Triggered by complaints from members who are not aware of this policy but have immediate/urgent shipments, we initially tried a verbal request to defer the implementation until stakeholders are informed. At the same time, a formal position paper has been drafted outlining the issues in the implementation of the said policy, including costs and delays. On the matter of cost, he explained that they are implementing COA-approved fees for meals and transportation of government personnel doing plant inspections. For example, fees for trips in Luzon outside Metro Manila should cost a maximum of P800 per personnel. On the matter of delays possibly due to insufficient number of BOC personnel, he assured that since this is an order from the Office of the Commissioner, they will find ways to augment the manpower to handle the inspections/monitoring. In the meantime, he said that for companies which have not been advised of the implementation of this policy, they will allow a certification or something like an oath of undertaking using a BOC form for the first shipment this year following this policy. After which, exporters need to comply already with the requirement. Please let us know if there are specific/other issues on this policy which we may include in the position paper to be submitted to the BOC Commissioner. We also encourage industry associations and PHILEXPORT Chapters to send their separate positions on this matter directly to the Commissioner for the numbers needed in this advocacy.
