OK, the Supreme Court has decided to hear a case regarding the applicability of subsidies for health care policies purchased through the federal exchanges instead of the envisioned state exchanges. The suit alleges that the law specifically states that ONLY policies purchased through state exchanges are eligible for the federal subsidies, and that the subsidies are NOT payable on insurance purchased through the federal exchange. This is a potentially HUGE problem as only 16 states have set up their own exchanges. The administration is arguing that this was merely an oversight in the wording and, of course, folks who purchased through the federal exchanges are eligible for the subsidies. They further contend that the lawsuit is a frivolous and cynical attempt by those opposed to the law to capitalize on a drafting error. Except for the inconvenient fact that it was no error, but a conscious decision on the part of the drafters of the law to browbeat states into setting up the exchanges. Well, the states didnt blink so theres now a problem. And theres cynicism in abundance, but it seems strangely concentrated on the other side of the debate. Not sure about that? Well, heres our old friend Mr. Gruber again, chief architect of Obamacare, ready to remove all doubt. Im sure the administration now wishes his $400K consulting contract would have included a gag order. And by the way, Im not against health care reform. What I am opposed to is lying and manipulation on a massive scale.
