Of course we all agree that one of the most heinous crimes that can happen is when someone does harm to a child. However, in this case, the father acted against his own best interests by trying to cover up for the mother who was suffering from severe postpartum depression – and in turn, she took advantage of him and allowed him to be prosecuted to save herself from incarceration. What happens when an attorney advises his criminal client to reject a favorable plea based on an incorrect understanding of the law and his client is then sentenced to a harsher sentence after a fair trial? This is one of those cases wherein the family and accused already has attorneys working on the case – but they need TOVA to review what has happened so far, and in the future, to see if there is any way possible to get some relief from the 30 year sentence received.
