Okiya Omtatah Okoiti Mr. Nyakina Wyclife Gisebe and I, have sued the Attorney General for promoting tribalism in his office and for establishing a Kikuyu ethnic hegemony in the senior management of the Office of the Attorney General, contrary to Articles 10, 232 and others of the Constitution.The High Court (Justice Lenaola) has certified Petition No. 292 of 2014 as urgent and ordered it to be heard on July 10, 2014. In the Petition, we accuse the AG of favouring his tribesmen during proceedings in two similar but already determined cases. Both cases involved lecturers at two public universities challenging the re- appointmentsof their Vice Chancellors: Prof. Olive Mugenda - a Kikuyu (Kenyatta University) and Prof. Mabel Imbuga - a Luhyia (Jomo Kenyatta University of Agriculture and Technology - JKUAT). The two professors were irregularly re-appointed through mere letters of re- appointment,without going through a competitive process.A group of six lecturers and members of the administration staff in Kenyatta University moved to court and challenged the re-appointment of Prof.Mugenda. Similarly, one lecturer at JKUAT moved to court and challenged the re-appointment of Prof. Imbuga. Both parties sued the AG and other public officials.In court, the AG decided to defend Prof. Mugendas re-appointment via a letter, but vehemently opposed the similar re-appointment of Prof. Imbuga, also via a letter. The AG strongly demanded that the position ofVice Chancellor JKUAT must be competitively filled. Strangely, he strongly argued that the position of Vice Chancellor Kenyatta University was properly filled without a competitive process. We are also challenging the establishment of a Kikuyu ethnic hegemony in the senior staff in the office of the Attorney General, which hegemonic reality we accuse of pursuing an tribal agenda in support of elitist Kikuyu tribesmen. All Kenyans must be treated equally before the law, and must benefit fully before the law, and there must be national representation in senior positions in the public service. A time has come when no Kenyan should playsecond fiddle to another, and tribalism has to be taken head on.I dare anybody to shout hate speech at me.
