Ondo lawmaker sues Jonathan, Mark, Senate over NDDC nominees Written by Taiwo Adisa -Abuja Tuesday, 26 November 2013 00:00 A member of the Ondo State House of Assembly representing Ilaje State Constituency, Honourable Olugbenga Edema has instituted a legal action against President Goodluck Jonathan, Senate President, David Mark, the Senate and the Attorney General of the Federation, Mohammed Adoki, over the nominees for the Board of the Niger Delta Development Commission(NDDC) whose list was read in the Senate last week. The lawmaker, in the suit with reference FHC/ABJ/CS/804/2013, is seeking to restrain the Senate from screening the president’s nominees already before the upper House, while also seeking an order of the court to retrain the President from inaugurating the Board. In the suit filed at the Federal High Court, Abuja, the lawmaker said President Jonathan had failed to comply with the provisions of Section 12 of the NDDC Act, 2000 in making the nominations. He also asked the court to affirm that the oil producing areas of Ondo State is entitled to one of the Executive Director Positions in the NDDC being the fifth largest oil producer in the federation and in line with the rotational clause in the NDDC Act, 2000. The lawmaker is also seeking an injunction restraining the Senate President and the Senate as a body from screening, confirming or considering the nominations sent to it by President Jonathan. The lawmaker is further seeking to stop the Senate from considering any list of NDDC nominees unless it contains the name of an indigene of Ondo State oil producing area as candidate for one of the three executive director positions. The lawmaker is also seeking the court to determine whether by the provision of Section 12 of NDDC Act an indigene of oil producing areas of Ondo State is not entitled to fill one of the three vacant positions including that of managing director, executive director finance and admin and executive director, projects, while also asking the court to determine whether the first respondent (President Jonathan) is under any compulsion or obligation to adhere to the rotational principles enshrined in Section 12 of NDDC Act.
