On 12th December, the Execution Petition filed by Rajneesh Aggarwal was listed for hearing before the Distt. Forum, Gurgaon. This was for the execution of the order of the DF confirmed by the National Forum and SLP dismissed on 10.11.14 by the Supreme Court against this order. No body from the Company or Bank has turned before the Forum in the hearing. Aggarwals representative, Ms. Vandana Aggarwal, also an advocate, prayed the President of the Forum for issuing the arrest warrants of Director of the Company and/ or order for the attachment of property of the Company. Her request was not acceded to saying that the Forum’s priority getting ordered money and implementation of its order. Now, the heaing is fixed in January, 2015. Fail to understand that how the complainant will get money if the Company is not executing the order of the Forum on its own. Non-appearance of the representative of a nationalized bank which has marked a lien reportedly for Rs. 2.5 lakh is also deplorable and intriguing. If such orders of arrest or attachment of property are issued, neither the concerned company nor others will dare to ignore the order of the Courts/ Forums with impunity. In the face of such builders which treat law in a contemptuous manner, Forum are proving ineffective in the first stage. It is more distressing when such company claims to be a reputed one. But what can be said when someone does not exercise the powers given to him under the law? My “Execution Petition” for the implementation of Forum’s orders is fixed for hearing on 24th and let me see whether this is repeated in my case or not.
