Our constitution contains dozens of protections for the rights of minorities, limiting the power of a numerical majority to infringe on the interests of the minority. Thus, Friedman — a Reagan appointee — rejected the attorney general’s efforts to characterize the case as about the “will of the people,” stating that no record of the trial could fully convey the personal sacrifice of the couple in the case, their children and thousands of others, who have not been allowed the most basic rights to form a family.
