PARENTS UNITY ZINDABAD PARENTS UNITY ZINDABAD White paper on DPSG management DELHI PUBLIC SCHOOL GHAZIABAD PARENTS ASSOCIATION, GHAZIABAD 265, Mukund Nagar, Hapur Road, GHAZIABAD July 19, 2014 WHITE PAPER ON FEE MATTER OF DPSG SCHOOLS (i)That the Districted Magistrate of Ghaziabad vide his order No.1236/2014-15/dt 25/04/2014 have instructed the self-financed schools to comply with the U.P. Government G.O. 1402 dt 11/10/2011 and restrained the schools to increase the fee till further order citing Hon’ble Supreme Court Order, NOC conditions, T&C of land allotment etc. (ii)That a Writ Petition Civil No. 26942 of 2014 was filed by The DPSG Public School Ghaziabad Society, Meerut Road, Ghaziabad in May 2014 with a prayer to quash the above said orders of District Magistrate, Ghaziabad and with a prayer to restrain the respondents from proceeding ahead with determining the fee structure, before the Allahabad High Court which is being heard by Hon’ble High Court. DPSG Society has also filed the Principal Secretary, UP Govt letter dated 16.6.2014 addressed to DM, Ghaziabad in the Court as Supplementary Affidavit for consideration. (iii)That a Writ Petition Civil No. 26289 of 2014 was also filed by the Bal Bharti Public School, Ghaziabad in May 2014 in the same matter before the Allahabad High Court which is being heard by Hon’ble High Court alongwith the WP(C) -26294/2014 of DPSG Society. (iv)That DPSG Parents Association has filed an Impleadment in both Writ Petitions i.e. No. 26942 of 2014 and 26289 of 2014 and the same has been accepted and the applicant association has been added as Respondent No. 6 in both Writ Petitions. (v)That the hearings in the abovementioned Writ Petitions took place on 09.5.2014, 14.5.2014, 19.5.2014, 22.5.2014, 27.5.2014, 2.7.2014, 7.7.2014 and 9.7.2014. (vi)That the Hon’ble Court No. 38 headed by Hon’ble Justice Manoj Mishra has pleased to pass an order on 9th July 2014 whereby the respondents have been asked to file their respective counter affidavits within three weeks and one week thereafter shall be for the Petitioners for filing rejoinder affidavit. The Hon’ble High Court of Allahabd vide ibid. Order also directed that till the next date of listing, no coercive action shall be taken against the petitioners pursuant to the impugned order. (vii)That a Writ Petition Civil (S/B) No. 3685 of 2014 was filed by Independent Schools Federation of India, Meerut Road, Ghaziabad before Lucknow Bench of the Allahabd High Courtin the same matter with similar prayer. (viii)That it seems that the Independent Schools Federation of India, Meerut Road, Ghaziabad before Lucknow Bench has not disclosed full facts regarding correct jurisdiction. Moreover, it seems that the Petitioner therein wilfully have not disclosed the fact that a similar Writ Petition is being heard at Allahabad High Court in the matter of Writ Petition No. 26942 of 2014 and Writ Petition No. 26289 of 2014 before Court No. 38 and the Court in that matter has already asked for counters vide order dated 9thJuly 2014. (ix)That thus misrepresenting the facts and concealing the facts, the Petitioner in Writ C No. 3685 before Lucknow Bench has got an interim stay on 11th July 2014. (x)That despite the fact that DPSG Society has filed an exclusive Writ Petition (Civil) No. 26942 of 2014 in Allahabad High Court and the Hon’ble High Court has already passed an order on 9.7.14 mentioned at para (vi) above, they have issued Enhanced Fee Bills during 16-18 July 2014. (xi)That DPSG Society has now unilaterally decided that DA coverage will be restricted to 75% of the DA Rate to be announced by the Govt of India in Jul 2014 and Jan 2015 and be limited to a max of 4.5% of the tuition fees that to printed over leaf of Enhance Fee Bill (amazing). (xii)That DPSG Society has issued Enhanced fee Bills for quarter Jul-Sep 2014 during 16-18 Jul 2014 in all three Schools with the last date of submission of fee as 20 Jul 2014 without late fee. (xiii)That they further organized an interactive session on revised fee in all three schools on 12, 13 & 14 Jul 2014 in the disguise of amicable solution in the matter. The observations/demands of DPSG Parents, during interactive sessions, were as follows:- (aa)The parents were of the view that when the case of DPSG Society regarding fee issue is sub-judice in Hon’ble Allahabad High Court, how can they charge the revised fee. (ab)The parents were of the view that fee at old rate should only be demanded by Schools till the matter is decided by the Hon’ble High Court. (ac) When the Schools have a system of revising fee after a gap of three years for past so many years, why they are insisting on revising the fee only after two years, this time. (ad)Why the schools are insisting on a new DA formula when the old formula (point system) was in place for so many years. (ae)On what basis DA has been calculated for quarter Jul-Sep to the tune of Rs 3647/-. The Principals were not even able to clarify it. (af)In past when tuition fee was revised after three years; the DA was charged afresh wef first quarter on the basis of point system. The DA accumulated over a period of three years i.e. till next revision, was by and large subsumed in revised tuition fee. This practice has also been abandoned. (ag)The schools have now (wef 01.4.2014) not only revised the tuition fee after two years instead of three years but also put burden of past DA along with new DA on the parents which is highly illogical and unethical. (ah) The price of CNG has gone down by 30% however the school has increased the transportation fee by approx 20%!!! (aj)AC fee is being charged exorbitantly i.e. Rs 1.6 lakhs from each class for running the ACs hardly for 100 days. (ak)Parents raised serious concern over quality of education being imparted for last 2-3 years in general. (xiv)That as per aforesaid legal position DPSG Scoiety as Petitioner in Writ No. 26942 is solely and exclusively governed by the directions issued by the Hon’ble Court in that matter as per order dated 9th July 2014. (xv)That DPSG Society has committed serious contempt of court directions by issuing Enhanced Fee Bills. (xvi)Keeping the above in view, Parents are requested to unite and ask DPSG Schools to immediately withdraw the Enhanced Fee Bills and issue revised Fee Bill as per old Fee structure for quarter Jul-Sep 2014 till further orders of the Hon’ble High Court in their Writ Petition (C) 26942 of 2014. (xvii)It seems that the DPSG Society has gradually losing its objective to impart good education in Ghaziabad for which it was committed for so many years and now applying all kind of tricks and tactics to extract as much money as possible. Outstanding Principals and many good teachers are leaving DPSG schools one by one. This is a matter of serious concern for parents and all concerned. (xviii)PARENTS ARE REQUESTED NOT TO DEPOSIT THE ENHANCED FEE. (xix)Only Parents Unity can shake their CONSCIENCE. So remain UNITED and have PATIENCE, till the GOAL is achieved.
