PM’s lawyers are seeking to stop the publication of the Ombudsman Commission’s investigation report on the Prime Minister. The OC failed to make an appearance after a court direction was served by the PM’s lawyers to the Ombudsman Commission yesterday afternoon for today’s appearance. This comes after Justice Davani issued a court direction for the OC to appear for an urgent application filed by the PM’s lawyers. The counsel is expected to give reasons as to why he should not be charged for contempt. Counsel representing PM O’Neill, Mal Varitmos told Justice Davani this morning that despite the short notice for appearance for today’s appearance, he had to make a late flight from Cairns into Port Moresby last night. The court also heard that despite Varitimos’s assisting lawyer Philip Tabuchi informing the OC at 4pm yesterday to make an appearance, the OC did not do so before Justice Davani. Justice Davani in accepting Varitimos submission said the lack of attendance by the OC was an insult to the judiciary. She said the Ombudsman should show an interest in the case and make an appearance, adding that she found their no-how totally unacceptable. The notice-of-motion was to prevent any form of report into the investigation of the Prime Minister’s misconduct in office from being published in any form until the Supreme Court determined if the PM can be independently investigated. They are also seeking for the referral of two sections of the organic law to the Supreme Court for determination. These are section 219(1)(a) of the Organic Law on the Ombudsman Commission and section 13 of the Organic Law on the Ombudsman Commission that outlines the functions of the commission.
