(PREFACE: I cant begin to tell you exactly how much I HATE making this loooong post; but I think it needs to be done to make sure everyone is aware of the resolution to a very stressful situation.) This has been a long, drawn out ordeal and after nearly 15 months; the charges filed against me for Disorderly Conduct (O.R.C. 2917.11) and Obstructing Official Business (O.R.C. 2921.31) by an officer with the Monroe Police Department on 10/13/2013 have been dropped. My attorney filed a motion to suppress the police report based on a violation of my Constitutional rights; specifically my 4th Amendment right against illegal search and seizure. That motion was accepted by the judge and the prosecutor has no choice but to dismiss the charges. If I thought for one minute that I had done anything wrong to deserve the type of treatment that I got, the extremely confrontational and disrespectful manner in which I (as a private citizen) was treated, or the charges that resulted from that confrontation; I would not have fought as hard as I had. I would have apologized and we would have moved on. This simple fact is that 90% of what was written in the officers report was completely fabricated. At no time did I ever attempt to use my position to influence the officer, I NEVER asked him Do you know who I am? (something only a huge jackass would do), I did not use the f word to the officer, and I was the person responsible for diffusing this officers self-induced situation. Furthermore, I was NOT intoxicated as stated in the police report; I was pissed off. I was livid that during a celebration of my sons return home from Afghanistan, defending the freedoms that we are suppose to be secure in - a sworn officer of my very own city decided to trample on just about every aspect of them including telling my son to sit down and shut up, attempting to forcefully drag me off of my deck, and threatening me with jail time, and getting nose-to-nose with me asking me if I wanted to take a swing at him. Im never one to air dirty laundry but when someone goes out of their way to make me and my family look extremely bad both in a police report and then to the Journal-News; I have no other recourse -- my wife deserved a hell of a lot better than a sworn officer of the law testifying that she was intoxicated -- my wife doesnt drink. She runs marathons, is an amazing mother, and is the pillar of decency. She deserved much better treatment than she received. My son deserved much more respect than being told to shut up, be called a smartass, and have a TASER pointed at him. This is an Airborne Ranger he was talking down to; that is unforgivable. With all of that said; we have an extremely professional and dedicated police force. One bad apple does not spoil the bunch in my mind. I have and will continue to support our PD in any way that I can and will continue to keep public safety my number one priority as a member of Council for as long as the people of Monroe will have me.
