PRESS RELEASE (TRAGIC DEATH OF ZIHAD) Children’s Charity Bangladesh Foundation (CCB Foundation) Vs Government of Bangladesh and others Writ Petition being Number 12388/2014 filed in the High Court Division on the tragic death of 4 year old innocent boy Zihad Children’s Charity Bangladesh Foundation (CCB Foundation), has filed a public interest litigation today on the tragic death of 4 year old Zihad. Ten persons have been made parties to the petition: (1) Secretary, Ministry of Home Affairs; (2) Secretary, Ministry of Railway; (3) Director General, Fire Service and Civil Defence; (4) Director- General, Bangladesh Railway; (5) Director (Operation and Maintenance), Fire Service and Civil Defence; (6) Chairman, WASA, WASA; (7) Administrator, Dhaka South City Corporation; (8) Dhaka Metropolitan Police Commissioner; (9) Deputy Commissioner of Police, Motijheel Division; (10) Officer-in- Charge, Shahjahanpur Police Station. In the writ petition following relief has been sought: Issue a Rule Nisi calling upon the Respondents to show cause as to why- (i) the inaction and/or negligence, and/or failure on the part of the Respondents No. 2, 4, 6 and 7 in particular and inaction and/or negligence on the part of the Respondents No. 1, 3 4 and 5 in respect of rescuing Jihad and resulting in tragic and shocking death of Jihad as watched by the whole nation and reported in all dailies and medias being violative of law of the country, human rights, fundamental rights and contrary to Articles 31, 32 and 36 of the Constitution of the Peoples Republic of Bangladesh shall be not declared illegal and without lawful authority and is of no legal effect. (ii) Direction shall not be issued upon the Respondents and the Government to give compensation of Tk. 30,00,00.00 (thirty lac taka only) to the family of deceased Jihad for gross negligence and violation of human rights and right to life guaranteed under Article 31 and 32 of the Constitution of the Peoples’ Republic of Bangladesh. (iii) Direction upon the Respondent Nos. 2, 4, 6 and 7 to make a list of pipes, wells, tube wells, sewerage pipes, holes and water tanks left uncared or uncovered or unsafe throughout the country under their jurisdiction and submit the list before this Honourable Court within 2 months shall not be issued. (iv) Direction and/or guidelines in general with regard to prevention of accidents as a result of uncared pipes, holes, water-tanks as a result of negligence by the Respondents shall not be issued. (v) Direction upon the Respondent No. 3 and 5 to produce before the court all information, data on purchase of expenditure on modern technologies and expertise they have with regard to rescuing people in life threatening accidents, particularly in the cases of falling in uncared pipes, holes, water-tanks, water-bodies, sewerage pipes, drowning, entrapping in fences etc. causing death-traps shall not be issued. (vi) Direction upon the Respondent Nos. 8, 9 and 10 to file a murder case against the Respondent Nos. 3, 4, 5 and 6 for causing death of Jihad as a result of their negligence shall not be issued. (vii) direct the Respondent Nos. 8, 9 and 10 to file a murder case against the Respondent Nos. 3, 4, 5 and 6 for causing death of Jihad as a result of their negligence. (viii) direct the respondents to give proper honour, appreciation and prize to Mr. Anwar Hossain, Mr. Nur Mohammad Litu, Mr. Abu Bakr Siddique Bablu, Mr. Shafikul Islam, Mr. Faruk and Mr. Kabir who rescued the dead body of Jihad within 15 minutes after abandonment of the rescue operation by the Respondents. (ix) invite the volunteer-rescuers Mr. Anwar Hossain, Mr. Nur Mohammad Litu, Mr. Abu Bakr Siddique Bablu, Mr. Shafikul Islam, Mr. Faruk and Mr. Kabir as appeared in the dailies (Annexure-A2, A3) to explain their simple device to be shown to the Respondent Nos. 3, 4, 5 and 6 so that these Respondents may learn simple devices for emergency rescuing and life saving. No writ Bench being available today, the petition could not be moved; however, it will be moved by Md. Abdul Halim, a Supreme Court Barrister (in person) whenever a writ Bench is available in the Supreme Court. With best regards Barrister Halim Bar-at-Law
