PUBLIC NOTICE: MARYLAND DEPARTMENT OF NATURAL RESOURCES FISHERIES SERVICE APPLICATION FOR SHELLFISH AQUACULTURE LEASES – Philip J. Harrington, III The Secretary of Maryland Department of Natural Resources (DNR), pursuant to Natural Resources Article, §4-11A-09(g), Annotated Code of Maryland, is giving notice of applications for two shellfish aquaculture submerged land leases by Philip J. Harrington, III in the Choptank River, Talbot County, Maryland. The first proposed area is located within the Upper Choptank River oyster sanctuary, approximately 1,200 feet south of the mouth of Bolingbroke Creek. The area applied for contains 28.1 acres, more or less, and is enclosed by a line beginning at corner 1, at or near Lat. 38° 34 45.0 N., Long. 76° 2 23.2 W., then running 301° 13 (True), approximately 492 meters to corner 2, at or near Lat. 38° 34 53.3 N., Long. 76° 2 40.6 W., then running 34° 55 (True), approximately 267 meters to corner 3, at or near Lat. 38° 35 0.5 N., Long. 76° 2 34.4 W., then running 126° 36 (True), approximately 418 meters to corner 4, at or near Lat. 38° 34 52.6 N., Long. 76° 2 20.3 W., then running 196° 19 (True), approximately 243 meters to the point of beginning. The second proposed area is located within the Upper Choptank River oyster sanctuary, south of the first proposed area and approximately 550 feet north of channel marker “27”. The area applied for contains 39.0 acres, more or less, and is enclosed by a line beginning at corner 1, at or near Lat. 38° 34 35.4 N., Long. 76° 2 27.1 W., then running 195° 6 (True), approximately 290 meters to corner 2, at or near Lat. 38° 34 26.3 N., Long. 76° 2 30.3 W., then running 308° 39 (True), approximately 655 meters to corner 3, at or near Lat. 38° 34 39.3 N., Long. 76° 2 51.7 W., then running 35° 40 (True), approximately 250 meters to corner 4, at or near Lat. 38° 34 46.0 N., Long. 76° 2 45.8 W., then running 126° 48 (True), approximately 557 meters to the point of beginning. The applicant proposes to deposit oyster shell as needed within each of the given areas to a maximum depth of three inches for the purpose of culturing Eastern Oyster (Crassostrea virginica), and to harvest using methods approved by the Department. In addition, any person who has a specific right, duty, privilege, or interest that is different from that held by the general public and may be adversely affected by one or both of the proposed leases may file a Petition of Protest with the Department. Petitions that meet the requirements of Natural Resources Article §4-11A-09(g) shall be forwarded to the Office of Administrative Hearings for adjudication.
