Phakeme the senior traditional leader of Mahlabathini passed away in December 2009. According to custom his successor must be appointed from amongst his children by the elders of the royal family. Samuel his eldest son, was identified as candidate for succeeding to the throne. However, Samuel wants to finish his LLB degree first before he assumes his responsibility as traditional leader. With reference to the facts given above, answer the following questions. 2.1 What procedure should be followed in order for Samuel to be recognized as a senior traditional leader? 10 2.2 Is it possible for Samuel to accept the appointment as a senior traditional leader, yet be excused for at least 2 years in order for him to finish his studies?
