Philex Mining gets final OK to operate Padcal mine MANILA, Philippines - Philex Mining Corp. can now resume normal mining operations at its Padcal mine in Tuba, Benguet. This after the Mines and Geosciences Bureau lifted the cease-and-desist order which was issued last August 2, 2012. The lifting will allow the company to resume normal mining operations in its Padcal mine, subject to compliance with the terms and conditions of the pertinent Mineral Production Sharing Agreements and provisions of Republic Act 7942 and its implementing rules and regulations, Philex Mining told the stock exchange. ABS-CBNnews Posted at 08/28/2014 | Updated as of 08/28/2014 MGB chief Leo Jasareno confirmed the lifting of the order. Because Philex has paid penalty to MGB and paid environmental obligation to PAB (Pollution Adjudication Board), the Mining Industry Coordinating Council (MICC) has verified that it did the remedial measures, the DENR has ruled that its appeal is moot due to compliance made and that Philex executed a sworn accountability statement, Jasareno said. The companys main mining site in Padcal suffered a spill of mine waste or tailings in August 2012 after the area was hit by two powerful typhoons. Philex voluntarily suspended operations, resuming production on March 8, 2013. Philex has already paid a P188.6 million fine to the PAB in relation to Republic Act 9275 or the Clean Water Act, and a P1.034 billion to the MGB on February 18, 2013 as penalty over the accidental discharge of sediment.
