Please BE KIND and the new handheld electronic device ban: Pictured below, Please BE KIND founder Al Bastidas addresses Austin Mayor Lee Leffingwell and Austin City Council Members, stating, “The law is designed to prevent the unnecessary loss of lives and to protect all road users and special those most vulnerable ones, such as pedestrians, cyclists and motorcyclists and our teenagers from getting hurt or sometimes killed. Al has visited numerous cyclists in hospitals and rehab clinics in Austin in the past eight years, many of them have critically injured as a result of the driver being on the phone. As the law stands now, texting is prohibited, but talking and dialing on a phone are still legal, making it difficult for officers to prove the person in question was indeed texting, With the new ban, a driver or cyclists can be ticketed for holding an electronic device, with some exceptions. Some people believe that cyclists should not be included on this law because there is not study that shows that cyclists cause crashes or injured other people, while riding and talking on their phones and the evidence of drivers injuring vulnerable road users is plenty. The new ban, however, aims to prevent all crashes, no matter who is at fault.
