Please READ and SHARE.... Ive just learned of some shit going on in East Clevelands municipal court thats got Judge Will Dawson more than a little worried. I was tipped off that county or state officials have been in his court for the past week investigating the misuse of LEADS / NCIC databases. Dawson has been accused of pushing one court employee to take LEADS / NCIC certification tests for all the courts employees. Investigators have been questioning employees, reviewing documents and examining the LEADS / NCIC queries theyve conducted. LEADS is owned by the state and NCIC is owned by the federal government. Ohios general assembly created LEADS in 1967. NCIC was created by congress and the U.S. senate in 1966. J. Edgar Hoover was the first FBI director to implement the NCIC databases and connect them with INTERPOL. The Ohio Highway Patrol supervises LEADS, and its owned by the Ohio Department of Administrative Services. The U.S. Department of Justice owns NCIC under the supervision of the FBI. Congress made protecting privacy a major factor in letting cops use NCIC databases. LEADS means Law Enforcement Automated Data Systems. NCIC is National Crime Information Center. The primary purpose of the LEADS database is officer safety. Cops are supposed to access the databases after a stop. Theyre not supposed to pull up behind you and check your plates. The state punishes LEADS / NCIC abusers under Ohio Revised Code section 2913.04(b) and 2913.04(c). Court personnel and cops cant use the equipment for anything other than a legitimate law enforcement purpose. The use has to be tied to either a stop where probable cause was determined before the databases were accessed, or for a legitimate investigative purpose. That means a complaint has to be generated. Courts are limited to using LEADS / NCIC databases for warrant information. Anything a cop or court employees describes as a legitimate law enforcement purpose isnt. Its unlawful for cops or court personnel to access the equipment just to check out someone who makes them curious. You ladies whove had cops pull up on you and they know your name already ... that shit was illegal. East Cleveland cop Antonio Malone is under indictment. Hes been accused of looking up information for his friends, family and potential dates. Cops and court employees use LEADS all the time for this bullshit, and its illegal. They all do this shit. Im giving it enough time. But Ill find out soon the name of every cop whos looked me up. They think they can do that shit in secret because no one knows. Cops are always looking up politicians and public figures. I guarantee if youre a mayor, councilman or a judge, cops have accessed LEADS / NCIC databases to investigate you and your family, and its illegal. If youre a mayor ask the Ohio Highway Patrol to run a query on your name and that of your family to see which one of your cops investigated you and your loved ones. Dawson signed a User Participation Agreement to use LEADS / NCIC databases consistent with the laws of Ohio and the policies enacted by the superintendent of the Ohio Highway Patrol. Mayors or safety directors should be signing the User Participation Agreements on behalf of the city, but theyve let the police chief sign it. Thats a big no-no because there isnt a law in Ohio that lets police chiefs sign contracts that bind a municipal corporation to any agreement. Mayors or judges as law enforcement officers have contracting authority.
