Please help us out as our sister company and the owner of Ema Jane has been sued by 11th Avenue, DBA GroopDealz. You can help us by first taking a poll here: https://apps.facebook/my-polls/nkygdu You can also help us by liking our GroupDealz page: https://facebook/groupdealz Groopdealz COO claims that our domain name groupdealz we purchased fairly on the domain market is theirs. 11th Avenue has asked a federal court to cancel our domain name groupdealz and to force us to transfer our domain name groupdealz to 11th Avenue. Although 11th Avenue does not have a federally registered trademark, 11th Avenue nevertheless claims that “we have adopted a strategy to intentionally and unlawfully trade off of that good will by infringing on 11th Avenue’s rights in that mark.” Of course, we dispute that, a lot. After our company, Group Dealz, LLC was sued by 11th Avenue, we reached out to 11th Avenue to work things out, even offered to sell them our domain. 11th Avenue’s only response was to demand that we cease from using our groupdealz domain name. Oh, and as soon as I started telling our story on our website and here on Facebook, I was promptly served with an Amended Complaint that claims that Group Dealz, LLC and its owner (personally) defamed them. Now, 11th Avenue is asking a court to issue an injunction against me, preventing me from exercising my right to free speech about what we feel we are suffering from in Trademark Bullying. Trademark bullying does exist, and we do not appreciate it in the least. We believe in fair play and healthy competition, not over the top lawsuits. We are a family run business, having already provided quality products, brands, and services to consumers and small businesses for close to a decade now with our other businesses, we purchased this domain name, groupdealz to start building our next friendly company with the goals of: • bringing fairness to consumers and esp. vendors and brands to the growing Group Deals marketplace • giving businesses a better marketplace without stressing them with high commissions and stringent requirements, or worrying about their brand being copied and undermined by the group site they trusted • opening up the group deals marketplace to all categories and genres in one place • providing consumers a safe, modest, and fun family-geared environment where they can get the best deals on their favorite products and brands in any category • being transparent and open with all our business practices so consumers and esp. vendors or brands can trust they are in good hands What do you think - Should 11th Avenue DBA GroopDealz be able to prevent us from operating our own domain and website because we use the words, Group and Dealz?
