New Anti-Deficiency Statutes Protect Lenders Per Combs Law Group Arizonas anti-deficiency statutes have protected borrowers from being sued for a deficiency after the foreclosure of a loan used to purchase a home. The Arizona legislature has now amended Arizonas anti-deficiency statutes to decrease the protection for borrowers. For mortgage loans made after December 31, 2014, there will be no anti-deficiency protection for borrowers if: 1.The home was not substantially completed. Substantially completed means that the final inspection has been completed, or the construction has been completed in all material ways as required by ordinances and regulations; or 2.The property was never actually used as a dwelling by the borrower; or 3.The property is owned by a commercial home builder who built the home with a construction loan. If any of these three exceptions apply, the borrower will not have anti-deficiency protection after foreclosure.
