Pool Safety - New compliance requirements - Pool owners selling or leasing their property must now provide compliance certificates. The introduction of the Swimming Pool Amendment Act last year required that all pool owners register their swimming pools on the NSW State Government’s online pool register by 29 October 2013. The Act also required that pool owners undertake a self-assessment of the compliance of their swimming pool with the applicable Australian Standard when registering their pool. Failure to register a pool makes pool owners liable to incur a fine of $220. The Act has also amended other regulations in relation to the selling and leasing of properties with swimming pools which place greater obligations on property owners. From 29 April 2014 swimming pool owners will need to provide a swimming pool compliance certificate (or an occupation certificate in respect to the pool and evidence that the pool has been registered) before selling or leasing a property that has a swimming pool. Amendments to the Conveyancing (Sale of Land) Regulations will require that property owners selling a property containing a pool must attach a valid swimming pool compliance certificate to their sale contract as a prescribed document. Property owners leasing property will be required under the Residential Tenancies Regulation to ensure that at the time a residential tenancy agreement is entered into that their pool is registered and they must provide the proposed tenant with a copy of a valid pool compliance certificate or an occupation certificate. If you have a property with a pool and have not registered it online you should do so immediately. If you intend selling or leasing a property with a swimming pool in the near future you should take steps to obtain a compliance certificate or occupation certificate before listing the property for sale or lease.
