Posisyon ng ‘Pinas sa Spratlys iginiit Oktubre 5, 2013 Abante News Naninindigan ang Pilipinas sa harap ng iba’t ibang bansa na kasapi ng ASEAN countries, na pinahahalagahan pa rin nito ang rule of law para manatili ang katiwasayan sa usapin ng pinagtatalunang South China Sea. Ito ang sinabi ni Department of Foreign Affairs (DFA)-West Philippine Sea Center Assistant Secretary Henry Bensurto Jr., sa harap ng mga delegado ng 2nd Expanded ASEAN Maritime Forum (EAMF) sa Kuala Lumpur noong nakalipas na Oktubre 3. “To maintain order and stability in the South China Sea, we need predictability in the way we all behave with each other. To be predictable means, we need to have certain agreed standards, rules and norms. These standards, rules and norms in turn must be objective, impartial and non-discriminatory. International law is one objective standard,” sa pahayag pa nito. Idinagdag pa ni Bensurto na sa usapin ng mga pinagtatalunang karagatan tulad ng West Philippine Sea, ang United Nations Convention on the Law of the Sea (UNCLOS) ang kinikilala ng mga bansang kasapi ng EAMF na Australia, China, India, Japan, New Zealand, Republic of Korea, Russia at ng United States. “There is a fundamental difference between entitlements and claims under international law. Expressed provisions of UNCLOS on maritime entitlements, including a coastal state’s Exclusive Economic Zone (EEZ), are rights that lawfully demand respect from all State-Parties. Claims, on the other hand, are just mere claims that may not necessarily generate rights unless duly proven in an appropriate forum,” paliwanag pa ni Bensurto. OFW FANATIC
