Posted by Muneer PROVIDE 25000 EACH FOR MARRIAGE OF POOR GIRLS: HIGH COURT TELLS GOVT Srinagar, June 16: The Jammu and Kashmir High Court has asked the state government to identify the girls to be married from the people it has already discovered as destitute and provide each of them Rs 25000 along with 5 grams of gold. “ That can easily be worked out. We would like you to start disbursing the amount, so that we are able to appreciate that the work done by the court is bringing some results and the deserving ones shall reap the benefit of these efforts,” a division bench of Chief Justice M M Kumar and Muzaffar Hussain Attar observed while directing state counsel Javed Kawoosa to disburse the amount to the poor girls. Observing the status report by the government on the scheme for destitute girls of the state as unsatisfactory, the division bench directed the government to re- look the draft scheme. “ The report does not make mention of the directions issued by the court in its preamble nor does it effectively deal with those directions. The draft scheme requires a second look at the hands of respondents so as to implement the directions issued by this court effectively,” the division bench said. The court observed it need not emphasize that girls numbering about 3,73,086 constitute a class in themselves, saying the directions issued by the court on December 30, 2013, have been upheld by the Supreme Court with a further direction for their implementation. “ There is no room left for any authority to deviate from those directions because the directions issued by the Supreme Court are binding on all the authorities under Article 142 of the Constitution,” the division bench said. It said the status report and the draft scheme do not in turn show compliance with the directions issued. “ We have discussed and explained various directions of this court with the learned state counsel who has assured us that needful shall be done before the next data of hearing,” the division bench said while hearing Amicus Curie B A Bashir and Additional Advocate General Javed Kawoosa. On December 30, 2013, the High Court had sought to formulate the scheme after perusing the report by the government identifying 3,73,086 girls as poor and hapless in J& K. For the scheme, the court had urged the government to carve out units in both urban and rural areas, which were in close proximity with each other where these girls were identified. The court had said two or three Mohalla or wards in urban areas and one or two villages in rural areas can constitute a unit and the girls of these areas be made part of Society or Cooperative Society which shall be, exclusively, for these girls and for their benefits. The court had asked the state government to constitute a separate fund for marriage purpose of nearly 4 lakh girls and a minimum of Rs 25000 be paid to a girl who is to be married and, as far as possible, five grams gold shall be given to her. In a Special Leave Petition, the state government challenged the High Court order before the Supreme Court, and the Apex Court lauded the work by the state government for improving the lot of destitute girls and found no illegality in High Court directions. The Apex Court asked the government to implement the High Court directions.
