Praise the Lord brethren, a lot has been said about the ruling on the case that was before high court in Kisumu, so intense was the propaganda war that one could not tell the truth but after obtaining an emailed copy from my brother Rev, Esitika, let me bring this out for the benefit of the church. in the ruling, the judge stated that; This were orders filled to restrain Mr. Mweresa from interfering with chuch activities and to hand over church properties Determination The application is brought seeking orders against a person who is not party to the suit. Look at page 3 paragraph II Because of this restraint, it may seem that the court has not analyzed all the issues raised and/ or has not made findings on them. to my mind, suffice is to state that the THE LEGALITY OR OTHERWISE THE LEADERSHIP OF THE CHURCH CAN ONLY BE FULLY ADDRESSED AFTER THE FULL TRIAL OF THE SUBSTANTIVE MOTION HEREIN. my opinion is that Mr Mweresa Kivuli and all other mentioned parties be enjoined in the suit and allowed to present their evidence. this will result in an informed decision of this court. in any event that this was a judicial review application. leave was granted on 11/12/2013. The current application is actually improper and the same was filled OBLIVIOUS OF THE FACT THAT THERE WAS A SUBSTANTIVE MOTION PENDING. PAGE4 In the premises and without DELVING INTO THE SUBSTANTIVE ISSUES RAISED IN THE MAIN MOTION, the same is dismissed with costs.
