Presumptive Eligibility for Psychosis and Other Mental Illness, was recently released with an effective date of June 19, 2013. This is a new directive which describes the policy to implement 38 USC 1702. Purpose: This directive provides the guidance contained in rulemaking AN87 which was effective on June 13, 2013. This directive provides the guidance for implementing 38 USC 1702, using the new regulation 38 CFR 17.109 which authorizes VA to provide presumptive eligibility and access to VA health care for non-enrolled Veterans who develop psychosis or mental illness other than psychosis within two years of their discharge from service. These Veterans will have access to health care only for their psychoses or other mental health conditions and any illnesses determined by VA clinical staff as being associated or related to them; but are not enrolled in VA health care for purposes of receiving the entire medical benefits package. While the Veteran is required to have an other than dishonorable discharge for this eligibility, it exempts them from the minimum service time requirements established in 38 USC 5303A. These Veterans will not qualify for enrollment and will be placed in Priority Group 8e, indicating they can only receive care related to their specific condition. For enrollment information contact the Health Benefits and Administration office: (432)263-7361 Ext, 7347 or 7348
