Prime Minister Jan Dhan Yojna-can Clerical Employees be forced to open Bank Accounts? Service Conditions of Bank Employees are governed by Sastry Award as modified from time to time by subsequent Bipartite Settlements. Job Profile of Clerical Employees settled at the apex Industry Level is given below. A perusal of job profile makes it undoubtedly clear that jobs related to account opening are outside the scope and purview of duties settled. Then Bank Employees need to obey only those orders which are not only lawful but reasonable too. Only disobedience of lawful and reasonable order has been defined as misconduct under Bipartite Settlement. So whether orders to open accounts can be regarded as lawful orders? As per Bipartite Settlement work will be equitably distributed and it will be ensured that every one has full days work. So once work has been so entrusted, can order to perform additional duties relating to account opening under jan dhan yojna be regarded as reasonable orders? Our Banks Book of Instructions contains instructions that no one would be allowed to remain inside the branch premises without the written permission of the incumbent Incharge. Additional work relating to account opening under this yojna over and above full days work would require sitting beyond working hours. In my considered opinion bank employees entrusted with such work must either refuse to obey the orders in line with the reasons given here in above stating that orders are neither lawful nor reasonable or they must seek written permission from no one other than incumbent incharge to permit sitting beyond working hours in accordance with the instructions contained in banks book of instructions. If incumbent incharge permits you, it will make you entitled for overtime as per provisions of Bipartite Settlement.
