Principle: Whoever does an act knowing that it is likely to cause death or with the intention of causing death, causes such death is guilty of murder. Facts: Kshitij and Ajaatshatru, two roommates, are fighting for the most beautiful girl in Nalsar, Ranjini. Realizing that he could never compete with Ajaatshatru‘s superior good looks and charm, Kshitij buys poison and mixes it with some food to give to Ajaatshatru. However, Ranjini walks into the room at this point and in his nervousness he promptly pushes it aside and completely forgetting about it, goes out with her. Later that day Ajaatshatru comes back into the room ravenous and seeing his favourite chocolate mousse, he gobbles it down. He dies of poisoning. Kshitij is prosecuted for murder. Is he guilty? a) Yes he is guilty because by choosing Ajaatshatru‘s favourite food he knew that Ajaatshatru would consume it. b) No he is not guilty because he did not do any act that directly caused Ajaatshatru‘s death. c) No he is not because Ajaatshatru consumed the food of his own volition. d) Yes he is guilty because he mixed poison in food with the intention for Ajaatshatru to consume it and with the knowledge that it would cause his death and Ajaatshatru died by such consumption.
