Program replication, by predominantly white colleges, relative to "HBCUs", has been deemed, legally, as having a segregative effect (regardless of intent). That is, if a predominantly white school "replicates" a program, of any kiind, which is offered at a nearby HBCU, caucasians will tend to go to the predominantly white school. This is a tangled web, however, of legislation, even in terms of "segregative effect", aside from questions liberty.
