Proposed Constitutional Amendment: Congress shall have no power to declare war, nor provide fiscally for deployment of forces outside the United States without a declaration of war. Congress shall have the power to call for a national referendum on whether or not to declare war. Congress shall designate a time and date for the referendum. As well as define who is eligible for military service. Only those who are eligible for military service may vote in the referendum. If the referendum is passed all those who voted for the referendum are automatically drafted into the armed forces. In the event of additional drafts of service members, those who did not vote will be selected. Those who voted against the referendum will be exempted from the draft until all others have been called up. Nothing in this amendment limits the power of the President to respond to an invasion of United States Territory.
