The period of Annual Judicial Recess falls between the months of July and September of every year. The authority to back up my argument is from The Supreme Court Rule Of 1985 As Amended and I quote. “Practice Direction In giving effect to the provisions of Order 6 Rule 5 of the Supreme Court Rules, 1985, the period of the vacation which is declared between July and September each year shall not be taken into account for the computation of the period of filing briefs by either the appellant or the respondent in an appeal before the Court.” Per: Supreme Court Rules of 1985 as amended. In one word, on 5th of May, 2014, the Honourable Justices of the Supreme Court of Nigeria will be on session to attend to the case (SC./69/2011) of Comandclem Nigeria Limited and Mobil Producing Nigeria Unlimited. Question 2 If Mobil Oil fails to show up in the Supreme Court Of Nigeria on 5th of May, 2014, would the case still continue in the Supreme Court of Nigeria? Answer To Questio 2 For your information, it is not the duty of CCNL to ensure that Mobil Oil shows up in the Supreme Court of Nigeria on 5th of May, 2014. The law is very clear on this fact. The instrument of the Supreme Court of Nigeria being adopted to call/invite litigants for hearing before it is called Hearing Notice. The documentary evidence a presiding judge relied upon to determine whether a litigant is served Hearing Notice or not is called an Affidavit Of Service. In one word, an Affidavit of Service is a document signed by litigants to show that parties have received court Hearing Notices inviting them to appear before a court of competent jurisdiction. The duty of a presiding judge is to ensure that Mobil Oil is served Hearing Notice, and An Affidavit Of Service is signed by Mobil Oil to show as evidence of serving Hearing Notice. The above principle of law was demonstrated by Honourable Justice Kayode Ariwoola (JCA) in the case of Ramawa versus NACB consultancy & Finance Co. Ltd when he said and I quote “Two conditions are prescribed for proof of service of processes of court on a defendant. The first is that there must be an affidavit of service. The second is that such affidavit shall be produced at the trail. Those two conditions must be satisfied in proof of service of process of court” Per: Honourable Justice Kayode Ariwoola (JCA) If the presiding judge can exhibit An Affidavit Of Service being an evidence of serving Hearing Notice inviting Mobil Oil to show up on 5th of May, 2014, the case will surely continue because of the fact that the right to fair hearing has been given to Mobil Oil but abused. In Nigerian principles of case laws, the Supreme Court of Nigeria has no business chasing Mobil Oil before they could be heard. Whether Mobil Oil shows up on 5th of May, 2014 or not, the case will continue because of the fact that the Supreme Court of Nigeria has no business pursuing Mobil Oil before they could be heard in the Supreme Court of Nigeria. All the Court is required to do is to create an enabling environment for the party to present his case and be heard. A party who refuses or fails to take advantage of the fair hearing environment created by the Court cannot accuse the Court of denying him fair trial.
