REQUIRED URGENTLY FOR CANADA : Ft. Mcmurey, Alberta, Canada: 1. Site of Employment : Ft. Mcmurey, Alberta , Canada ; 2. Contract Duration : 36 months ; 3. Start date: before August, 15 2013; 4. Employee’s Position : Welder; 5. Basic’s Hourly Salary : 34 CAD ; 6. Regular Working Hours : Maximum of 8 hours per day, 5 days per week ; 7. Overtime pay : a) For work over regular working hours 150% b) For work on designated rest days and holidays 150% 8. Leave with full pay : a) The employee is entitled to 2 weeks ( 14 days ) paid holiday per annum for the first year. Starting with the second year the employee is entitled to 4 weeks paid holiday. b) Sick leave based on doctor notice. 9. Job description: Read and interpret blueprints or welding process specifications Operate manual or semi-automatic welding equipment to fuse metal segments using processes such as gas tungsten arc welding (GTAW) / gas metal arc welding (GMAW), / flux-cored arc welding (FCAW), / plasma arc welding (PAW),/ shielded metal arc welding (SMAW),/ oxy-acetylene welding (OAW), / resistance welding and submerged arc welding (SAW) / Operate manual or semi-automatic flame-cutting equipment / Operate brazing and soldering equipment / Operate metal shaping machines such as brakes, shears and other metal/ straightening and bending machines / Repair worn parts of metal products by welding on extra layers 10. Free Transportation to the site of employment and in the following cases, free return transportation to the point of origin: a) Expiration of the contract b) Termination of contract by the Employer without just causes. c) If the Employee is unable to continue to work due to work connected or work aggravated by injury or illness d) By force major : and e) In such other cases when contract of employment is terminated through no fault of the Employee: Part 2 – Standard Employment Contract 11. Free food at the construction site and free housing. 12. Free emergency medical and dental services and facilities including medicine: 13. Workmen’s compensation benefits for service-connected illness or injuries or death in accordance with the pertinent laws of Alberta, Canada : 14. In the event of death of the Employee during the terms of this agreement, his remains and personal belongings shall be repatriated to the India at the expense of the Employer. In case the repatriation of remains is not possible, the same may be disposed of upon prior approval of the Employee’s kind and or by the Embassy / Consulate nearest the job site: 15. The Employer shall assist the Employee in remitting a percentage of his salary through the proper banking channel or other means authorized by law: 16. Termination : neither party may unilaterally cancel the contract except for legal, just and valid cause: a) Termination by Employer – The employer may terminate this contract on grounds of closure or cessation of operation of establishment / undertaking or due to retrenchment to prevent losses, by serving a written notice to the Employee at least one (1) month before the intended date thereof or payment of separation / termination pay equivalent to one (1) month salary. The Employer shall bear the repatriation expenses of the Employee. The Employer may also terminate the Contract on the Following just causes: serious misconduct, willful disobedience of employer’s lawful orders, habitual neglect of duties, absenteeism, insubordination, revealing secret of establishment, engaging in trade union activities, when Employee violates custom, traditions and laws of and/or terms of this Agreement. The Employee shall shoulder the repatriation expenses. b) Termination by the Employee – the Employee may terminate this Contract by serving one (1) month advance written notice to the Employer. If no notice is served, the Employee shall shoulder all expensed relative to his repatriation back to his origin. The Employee may terminate this contract without serving any notice to the Employer or his representative: inhuman and unbearable treatment accorded the Employee by Employer or his representative and violation of the terms and conditions of the employment contract by the Employer for his representative Employer for his representative. Employer shall pay the repatriation expenses back to the Philippines. c) Termination due to illness: either party may terminate the contract on the ground of illness: diseases or injury suffered by the Employee. The employer shall shoulder the cost of repatriation. Part 3 – Standard Employment Contract 17. Settlement of disputes: all claims and complains relative to the deployment contract of the Employee shall be settled in accordance with Company politics rules and regulation. In case the Employee contests the decision of the Employer, the matter shall be settled amicably with the participation of Labor Attaché or any authorized representative of the embassy / Consulate nearest the site of employment. In case the amicably settlement fails, matter shall be submitted to the competent or appropriate government body in (host country). 18. The Employee shall observe Employer’s company rules and abides by the pertinent law as of the host country and respects its customs and traditions. 19.
