RESOLUTION: SHAHEED BHUTTO CASE Resolved in the meeting held in Central Secretariat, Pakistan Peoples Party on 20-8-2013, the Pakistan Peoples Party should become a party before the Supreme Court of Pakistan in the Reference filed by the President of Pakistan under Article 186 of the Constitution of the Islamic Republic of Pakistan challenging the conviction and sentence of founder father of Pakistan Peoples Party, President, Prime Minister of Pakistan Shaheed Zulfikar Ali Bhutto. The Secretary General of Pakistan Peoples Party, Sardar Lateef Khan Khosa is authorized to file an appropriate application as in the nature of an intervener to the proceeding of the apex court in the aforementioned Reference. This has been found necessary to straighten / set the course of history right which stands distorted by the dictatorial regime of General Zia ul Haq who deposed the then Prime Minister, dissolved the Parliament and Assemblies, imposed Martial Law, fabricated, forged, manipulated, created false evidence and masterminded the false criminal prosecution against the greatest leader of the Third World, the acknowledged statesman of Muslim Ummah, the architect of the Constitution and savior of the 90000 plus soldiers from the Indian prisons, retrieval of 5000 square miles of Pak land from enemy occupation and made Pakistan an atomic power fortifying the defense of motherland impregnable. The judicial verdict of Lahore High Court headed by the illegally appointed Chief Justice of Lahore High Court Maulvi Mushtaq Ahmad by Gen. Zia ul Haq was wrought with illegalities and irregularities which have been widely commented upon by jurists within and abroad unanimously proclaiming the worst judicial precedent tantamounting to the judicial murder of Shaheed Zulfikar Ali Bhutto. The Appellate Court headed by hand pick Chief Justice of Gen. Zia ul Haq, Sheikh Anwar ul Haq also defaced and mutilated all the norms of justice by dismissing the appeal as also the Review Petition of Shaheed Zulfikar Ali Bhutto. Voluminous legal opinions, editorials, books written by the Pakistani as well as foreign think tanks, lawyers and leaders from across the globe have condemned the judicial proceedings as well as consequential hanging of Shaheed Zulfikar Ali Bhutto. Such leaders are born in centuries and the Constitution of Islamic Republic of Pakistan 1973 which despite interceptions remains the unifying force of federation and strength of Pakistan was solely spearheaded by the great leader whose untimely death in such a cruel and barbaric manner not only deprived the people of Pakistan of a visionary par excellence but the motherland stands stifled and has been periled under the colossal problems of such magnitude which are beyond the cognizance comprehension and rectification of the leadership of the day which by comparison stand nowhere near the greatest leader Shaheed Zulfikar Ali Bhutto after the demise of Quaid-e-Azam Muhammad Ali Jinnah who died within short span of the independence. Since Shaheed Zulfikar Ali Bhutto, the founder father of Pakistan Peoples Party which is now headed by his grandson Bilawal Bhutto Zardari thus feels that the stigma on the face of superior judiciary needs to be erased as Pakistan Peoples Party all through out believes in the independence of judiciary and strengthening the institutional edifice of the State, therefore the judgments under challenge through the Presidential Reference being per-in-curium need to be revoked, nullified, set aside, reversed and revisited in the interests of justice and the grandeur and glory of the Supreme Court of Pakistan as well as strengthening the rule of law and enforcing the Constitutional mandate in its true ethos and spirit. The Secretary General may associate any lawyer and seek help and assistance from national and international jurists as deemed fit and appropriate
