Raila Odinga and his opposition team take the slightest opportunities to poke holes into the Jubilee government and to demand for its resignation while they are fully aware that were he or anyone else, for that matter, the president of Kenya under the current constitution he would perform in the same way if not worse. Those who join their choruses are mostly ignorant of the presidents legal limitations. I do not know where the oppsition would fetch extra powers to govern if they were not to use the unprovided-for draconian methods which the current president is keenly avoiding to. We have a fluid constitution full of loopholes (I did not vote for it; the Church also cautioned us on its present form, e.g. the camouflaged right to abort) which can to an extent be abused to dangerously safeguard impunity and lawlessness under the guise of freedom of expression, human rights, security of tenure for state officers, independent state organs, etc. For instance he cannot directly sack/suspend the chairpersons of commissions. The former constitution provided that every public servant in the Republic of Kenya does so at the pleasure of yhe president. Of course the current one is largely better than the former as we may not wish to have an imperial president, but the current one renders him almost toothless. For him to be more efficient in his supervisory and executive roles Kenyans of goodwill have to equip him better through their elected law-makers. Otherwise every public doings and misdoings will always take us in circles with accusations and counter-accusations till finally, and usually quite swiftly, without giving a second thought, someone declares that the buck settles with the president and the rest of us join the chorus. If something is not done about his powers the current and any future president will have very hard time running the country and this risks it to turn into anarchy.
