I was going through random cases and i found this :) :p *Human heart is not a “plant”* The assessee, a lawyer, claimed that his heart be considered as a plant and accordingly, expenditure incurred on by-pass surgery were in the nature of current repairs. The HC held that, deduction for current repairs on plant would not be available because the heart of a human being could not be considered as a plant asit cannot be reflected in the balance sheet as an asset and to arrive at a cost of acquisition for such heart would be difficult.. Furthermore, it cannot be said that the heart is used only for professional activity so asto treat it as “plant” of the profession carried out by the assessee and also the expenditure had not been incurred wholly and exclusively for the purpose of business or profession of the assessee.
