Reason why NASS cannot take over LEGISLATIVE proceedings in RIVERS STATE: Following the crisis that erupted at the Rivers state House Of Assembly two days ago. The Federal House of Representatives passed a Resolution declaring Legislative Emergency in the state. They cited section 11(4) of the constitution which constitutionally empowers them to take charge,but that same section also cannot take effects if sub-section (5) is invoked or in practice. 11 (4) At any time when any house of Assembly of a state is unable to perform its functions by reason of situation prevailing the state, The National Assembly may make such laws for the peace, order and good government of the state with respect to the matter on which the House of Assembly may make laws as may appear to the National Assembly to be necessary or expedient untill such time as the [State] House is able to resume its functions; and any such laws enacted by the National Assembly pursuant to this section shall have effects as if they where laws enacted by the State Assembly. Provided that nothing in this section shall be construed as confering on the National Assembly powers to remove the Governor or Deputy Governor of the State from Office. 11 (5) For the purpose of subsection (4) of this section, a house of Assembly "shall not" be deemed to be unable to perform its functions so long as the House Of Assembly can "Hold a meeting and transact business". It is on this subsection 5 that I, believe, that the House, having held series of meeting and conducted a plenary even after the chaos on Tuesday, and with Majority of members on their side during those occasions, it is improper and not In a sense of true Democracy, True Federalism, for the National Assembly to take over Legislative affairs in RIVERS STATE. I call on the SENATE not to concur on the RESOLUTION passed by the HOUSE OF REPS, as such would make the resolution null code void. We should allow those (majority)dully elected by their people to run their affairs.
