Regarding DePieros trial to resume (Page L-7, Aug. 27): Its easy to think the court fight is just about two companies battling over turf – until you realize that spot zoning is the real issue that riles residents. Allegations suggesting that the law has been bent to accommodate property owners and their deep-pockets partners has scant place before municipal governing bodies and planning boards, even though action by both is what has brought Montvale to court over master plan changes and commercially beneficial rezoning. Until the court challenge, the redevelopment plan has moved slowly and smoothly in Montvale, culminating in warm, welcoming approval by both elected and non-elected officials. Amendments to both the master plan and zoning were tailor-made responses to a concept plan presented for the redevelopment long before the amendments. Once the concept took hold, it was unstoppable locally. That makes some people claim in court that this is spot zoning favoring a crushing commercial footprint in Montvale, where the master plan is never finished. Only this month, the zoning board discussed a master plan re-examination report. What will they do next? Kurt F.
