Rent Watch: Q: I’m looking for a new place to live after being in my current unit for more than 10 years. My income is a mixture of investments and Social Security benefits. I’ve been searching Craigslist and have noticed that many landlords require stable job income and want to have employment references. Can I be denied a unit because I don’t have regular employment? A: The California Fair Employment and Housing Act (FEHA) prohibits discrimination because on the source of your income. Although a housing provider may require prospective tenants to demonstrate sufficient income to pay the rent, it is illegal to require that the income comes from employment rather than a different source. In other words, a landlord may not distinguish between employment income, social security, disability income, or any other lawful source of income in determining whether an applicant has sufficient income to pay the rent.
