Republic of Botswana TELEGRAMS: DEFA MINISTRY OF FOREIGN AFFAIRS TELEPHONE : 3600700 AND INTERNATIONAL COOPERATION TELEX : 2414 BD PRIVATE BAG 00368 Fax : 3913366 GABORONE PRESS RELEASE REPUBLIC OF SOUTH AFRICA ENACTS AMENDED IMMIGRATION ACTS The Ministry of Foreign Affairs & International Cooperation wishes to inform the public that the Republic of South Africa has enacted Immigration Amendment Act of 2007 and Immigration Amendment Act of 2011. The amended Acts came into effect on 26th May 2014. The Acts contain new regulations which will affect various categories of travelers to South Africa. The newly introduced regulations are as follows:- For children travelling to and from South Africa, the following apply: Where parents are travelling with a child/children, the parents must produce an unabridged birth certificate of the child reflecting particulars of the parents; In case one parent is travelling with a child, he/she must produce an unabridged birth certificate and consent in the form of an affidavit from the other parent, a court order granting full parental responsibilities and rights or legal guardianship in respect of the child or a death certificate of one parent, where applicable; Affidavit from parents or legal guardian; copies of identity documents of parents as well as contact details of parents/ legal guardian in case the minor is not travelling with parents. The following penalties for overstaying in South Africa now apply: A person who overstays for a period not exceeding 30 days, will be declared undesirable for 12 months; In the case of a person who overstays for the second time within a period of 24 months, he/she will be declared undesirable for a period of two years; and In the case of a person who overstays for more than 30 days, he/she will be declared undesirable for five years.
