SB 1775 Description: Ban Weaponized Drones Why is this legislation needed? Beyond certain FAA airspace restrictions, there are no laws regulating drone use in Hawaii. Drone surveillance is fast proliferating and Hawaii was recently selected as a test site for the FAAs drone integration program. Drones raise new privacy concerns and their surveillance capabilities are much wider than conventional aircraft. Expansive law enforcement using high-tech, military-grade surveillance means increased incarceration and insecurity for our communities. There are a number of drone bills this Legislative session but only HB 1775 provides real, not figleaf, protections against misuse and abuse of personal information by the government. HB 1775 is the only bill to reject warrants as the primary protective mechanism against mass surveillance. Importantly, HB 1775 limits police use of drones to emergency and lifesaving situations, bans the weaponization of drones, and creates a robust reporting regime that will keep the Legislature and the public engaged. HB 1775 upholds Hawaiis high privacy standard and protects the communities most likely to be disproportionately impacted by the use of drones by law enforcement. HB 1775 does not burden hobbyists or drone use for the preservation of human and animal life. The bill makes further exceptions for certain environmental and commercial uses of drones.
