SC ruling puts JK in tight spot Govt has no option but to recall IrfanYasin: Advocate General Appointment of VC LAWDA MUDDASIR ALI SmallerDefaultLarger Srinagar, July 2: The state government is in a fix over re-calling IrfanYasin, former vice-chairman Lakes and Waterways Development Authority (LAWDA) after the Supreme Court upheld the State High Court’s stand Okaying the extension in the service of former LAWDA head. A senior official in the General Administration Department (GAD) said the Government would examine the Supreme Court judgment. “We will go through it and accordingly take a decision,” GAD official said. On Tuesday the Apex Court bench of Justices T S Thakur and C Nagappan had dismissed the Special Leave Petition filed by the J&K Government, challenging the State High Court’s ruling for extension in the services of IrfanYasin. “No merit. The Special Leave Petitions are dismissed,” the SC had ruled. The Advocate General MI Qadri said the state government has no option but to implement the order. He said the government would require recalling and re-appointing Yasin as VC LAWDA in the wake of the SC judgment. “But a new VC of the body will also have to be appointed simultaneously so that he gains experience and knowledge of running the body,” Qadri said. The controversy over extension in the services of Yasin erupted last March when he completed one year extended tenure following his retirement in March 2013. In view of the ongoing program for conservation of the Dal Lake the High Court had last March directed the State Government to retain Yasin as VC LAWDA for a period of six months beyond one year extension. However, the State Government issued an order asking Vice-Chairman Srinagar Development Authority (SDA), Shafaat Noor Barlas, to take additional charge as Vice-Chairman of the LAWDA, on the superannuation of Yasin, on March 31. The order was issued by the Secretary H&UDD, Satish Nehru, on March 27, the day the High Court passed the directions in Favor of Yasin. The court issued the directions in the much-publicized PIL concerning the Dal Lake on an application filed by Amicus Curie senior Advocate Zaffar Ahmad Shah. MI Qadri said the state Government filed a Special Leave Petition in the Supreme Court, challenging the order of the division bench of the High Court. “The Supreme Court has dismissed the SLP upholding the High Court order to continue with IrfanYasin. But the government will require appointing new head of the body so that he gains experience and knowledge of running the LAWDA which looks after restoration of Dal Lake,” Qadri said.
