The Judiciary stated that it expected Mark to clarify the matter. The following is the statement - STATEMENT FROM THE JUDICIARY The Judiciary notes comments in the media regarding the matter of Larry Howai v Azad Ali Sunshine Publishing Company Limited- CV 2015-00159. While there appears to be some misunderstanding which we expect the Honourable Speaker of the House to clarify, the Judiciary can confirm that no Notice, letter or any other communication on the matter was forwarded by the Court or any of its officers to the Speaker or any officers of the Parliament. This is an update to the article related to Senior Counsel Martin Dalys response to the issue. SENIOR Counsel Martin Daly yesterday expressed alarm at a combination of developments involving the Judiciary, the legislature and members of the executive. “It would be obvious to most citizens that there are grave dangers if there is politics in court business or if the High Court appears to be involved in political business,” he said in a statement yesterday. And Daly, in his statement, pointed out that statements attributed to House Speaker Wade Mark at the start of last Friday’s sitting raised “serious questions”. He said he was extremely disturbed therefore to have read in Saturday’s print media, statements attributed to the Speaker of the House of Representatives, uttered prior to the commencement of a motion of censure against Finance Minister Larry Howai. Mark was quoted in Saturday’s Express as saying: “I received only a few hours ago a notice from the High Court of the Republic of Trinidad and Tobago, dated January 16, 2015, a matter involving Larry Howai and Azard Ali of the Sunshine Publishing Company”. Daly noted that Mark’s statements were made in the context of the likely application of the sub judice rule to the motion. The former Law Association president said after reading Mark’s statement on Saturday he had waited to see whether there would be any challenge to the newspaper report. Daly continued: “I ask: Did such a notice come from the High Court to the Speaker. If it did, why would the High Court send such a notice? Further, if it did, pursuant to what duty did the High Court send it? Alternatively did the Speaker ‘mis-speak’ and, if so, why? “Additionally, in my view, the above questions require urgent answer, particularly because: 1. They arise so soon after apparent irregularity affecting high profile litigation between the Attorney General and the Leader of the Opposition. 2. They have been followed today by equally disturbing and unanswered allegations about approaches to a witness in another matter between the Attorney General and the Leader of the Opposition,” Daly stated.
